MEMBERSHIP AND SITE: You shall treat as strictly confidential all information, whether technical or commercial, obtained or received by you in connection with these terms and shall not publish or otherwise disclose to any person any confidential or copyrighted information. Misuse of passwords or databases will void membership with immediate effect with no refund of subscription payment.

SEVERANCE: If a term, covenant, provision, or condition of this agreement becomes, or shall be held by any court of competent jurisdiction to be against public policy or illegal, all remaining provisions of this agreement shall remain in full force and effect and unaffected, impaired or invalidated by this decision. The invalidated item shall be modified by the parties to the full extent possible to carry out all the intentions and directives stated in this agreement.

GOVERNING LAW: Any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England, and you and PayNPlay irrevocably submit to the non-exclusive jurisdiction of the English Courts. This agreement is governed by English law and all disputes will be handled solely in the United Kingdom. English Courts will have jurisdiction in respect of it. You consent to such venue and jurisdiction. PayNPlay controls and operates its Web site from its offices in the United Kingdom and makes no representations or warranties that its content or use is legal in other locations.

VARIATION: PayNPlay reserve the right to change its policies and terms at any time. Any such changes will be posted on this page. Price and availability information is subject to change without notice.

OFF ROAD SITE DATABASE: Use of the PayNPlay ("we", "us", "PayNPlay"") Off Road Site Database constitutes acceptance of the PayNPlay User Agreement ("the agreement") and Terms of Use ("terms"). The user ("you") represent that you have read and understood these terms and agree to be bound by them.

We do not guarantee that all sites are in our database. Therefore we give no representation or warranty as to the accuracy of the content of the database either expressed or implied and assume no responsibility for errors or omissions. The database is for informational purposes only. It must be understood that by the ever changing nature the medium, the database will always have discrepancies. We disclaim all liability in respect of such information and its provision. Neither PayNPlay nor any of the site's editors or contributors shall be liable for any loss or damages, speeding fines or points on your licence suffered as a result of any use of the database, including but not limited to direct loss or consequential loss.

In order to use the PayNPlay Off Road Site Database you must agree to be legally bound and to abide by the terms and to indemnify and hold PayNPlay harmless from all alleged or actual damages, claims and expenses. This also includes, without limitation, attorney's fees. The use of the software is deemed to be an agreement of this condition. The UK database is 100% legal. However, there are questions of legality of use of such databases in some countries. Any non UK sections of the PayNPlay database is therefore for informational purposes only.

If a term, covenant, provision, or condition of this agreement becomes, or shall be held by any court of competent jurisdiction to be against public policy or illegal, all remaining provisions of this agreement shall remain in full force and effect and unaffected, impaired or invalidated by this decision. All POI databases, including the Off Road Site Database, are provided with a license for individual use. You are not allowed to copy, redistribute, concatenate or use these data in any way without the permission of the originators. This includes consolidating the data onto CDs or any other storage medium. Under no circumstances are you permitted to sell the data commercially in any format without a license from PayNPlay or the originator of the data set.

Thousands of working hours have been spent (and ongoing) obtaining, compiling, collating, validating, editing, formatting, distributing, supporting and improving upon the database.

The database is a compilation of data arranged in a systematic way. PayNPlay makes a qualitatively and quantitatively substantial investment in the collection, assembly, verification, organization and presentation of the contents of the database and a significant investment of human, financial and technical resources. This entitles PayNPlay by law to claim sole copyright of the database.

A number of fluid, changeable methods are in place where we can easily identify copied versions of the Off Road Site Database. All individual downloads and batches of the Off Road Site Database can be identified both to a particular download and member. For commercial reasons we do not disclose details of this protection methodology nor do we give all (some will be obvious to the more technical) system or visual clues that protection is active. Attempts at corruption of the protection system and consequent dissemination of the data will result in prosecution. The database and data contained within it are owned by and copyright of PayNPlay. This data is not allowed to be shared, reproduced, incorporated on any website or in any application including CD and DVD or newer media in part or in full without our prior written authorisation from PayNPlay.

Data, text, graphics, indicia and code are protected by UK, US, EU and International Copyright Laws, and may not be copied, reprinted, published, translated, hosted, or otherwise distributed by any means without explicit permission. All Off Road Site Database subscriber and non-subscriber submissions, additions and amendments automatically become the individual and collective property of PayNPlay. No permission will be granted to companies, organisations, websites or author's who distribute our data without a current commercial PayNPlay license.

You may not store any content downloaded from PayNPlay on any platform accessible to anyone apart from the purchaser, including personal computers, network computers, mobile devices, http and ftp servers. Content must not be served dynamically to more than one person, that person being the purchaser. You may not transfer ownership of our content to another party. You may not sell any of our content on auction sites nor include it with or within any item sold on an auction site. You may not modify, disassemble or reverse-engineer any content downloaded from this site. You may not distribute any content from this site (free or for a fee) as part of a package without prior permission from PayNPlay.
